Welcome to the Legend's Path Adventures ("the App"). By downloading, accessing, or using the App, you agree to comply with and be bound by the following Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Changes to Terms

We reserve the right to modify, update, or change these Terms at any time without notice. Your continued use of the App following any changes constitutes your acceptance of those changes.

3. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found here. Please review the Privacy Policy to understand how we collect, use, and disclose your personal information.

4. Eligibility

You must be at least 13 years of age to use the App. If you are under 18 years of age, you must obtain parental or legal guardian consent before using the App.

5. User Account

To use the App, you will be required to create a user account. You are responsible for the actions taken under your account, including any and all activities you choose to engage in to earn steps and active minutes. Exercise is generally considered safe for most people but may not be safe for you. If you have any concerns about becoming more active or generally wish to understand the risks involved, you must consult with a healthcare provider. When you create a user account, you explicitly accept responsibility for any and all outcomes related to your exercise and activity, including any behavioral changes you adopt to maximize your performance in the app.

6. Use of the App

You agree to use the App in accordance with all applicable laws and regulations. You will not engage in any activity that interferes with or disrupts the App's functionality or the experience of other users.

7. User Content

You may have the opportunity to submit content, such as text, images, or videos, to the App or to NextYou. By submitting such content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform the content in connection with the App.

8. Termination

We reserve the right to terminate or suspend your access to the App at our sole discretion, without notice, for any reason, including but not limited to a violation of these Terms.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App, (b) any unauthorized access to or use of our servers and/or any personal information stored therein, (c) any interruption or cessation of transmission to or from the App, or (d) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the App, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of New Jersey. You agree that any dispute arising from or relating to these Terms will be subject to the exclusive jurisdiction and venue of the courts located in Hunterdon County, New Jersey.

13. Entire Agreement
